Strained Sibling’s Relationship Leads to Daughter of Deceased Mother to Contest Will & Gain Settlement

Our client, a daughter of the deceased, contacted GMP Conesting Wills Lawyers, when she learnt that the deceased, had not adequately provided for her in her last will and testament. Our client explained to Garbis Kolokossian, an extremely successful contested wills lawyer, that she provided extra care for her mother prior to her death. Our client had numerous questions about contesting a will and whether she met the grounds to contest a will. Our client was successful in her claim and the matter settled outside of court.

Our client had a very close relationship with her mother, which extended to her death. Our client provided domestic assistance to her mother prior to her death and continually looked out for her wellbeing. However, she had a difficult relationship with her siblings prior to her mother’s death. After her mother’s death, our client’s relationship with her siblings further deteriorated.

It was explained to our client at the initial conference that she was eligible and fell within the criteria of a person that could consider a contesting wills claim. It was also relayed to our client that as her mother has passed away in New South Wales, the applicable New South Wales legislation would apply.

GMP Contesting Wills Lawyers made contact with the executors of the estate in relation to this claim. Subsequently, a summons was filed at the Supreme Court of New South Wales to commence proceedings.

Extensive affidavit evidence was filed by our client and the defendant in relation to the estate, at the Supreme Court of New South Wales.

An offer of settlement was conveyed in an effort to quickly, cheaply and justly resolve the matter, which was accepted.

Our client now owns a significant percentage of the estate, to which she was always entitled to and has a peace of mind for the future.

This case shows that GMP Contesting Wills Lawyers are a highly specialise and focused lawyers with a law firm small enough to care intimately for our client, but large enough to have the solid financial, medical and expert resources our client need to match the big insures we fight every day.
