Contesting a Will for Proper Recognition of Son’s Relationship With His Mother

Our client’s mother passed away and left her entire estate to her grandchildren and family friends. Our client had always maintained a close relationship with his mother and could not understand her decision to leave him out of her will. Our client had always been close to his mother and assisted his parents to buy their house. Our client provided ongoing financial assistance to his parents and maintained a particularly close relationship to his mother. Our client always made sure that his mother was involved in his life and had plenty of time to spend with his children. Even after they moved to different states our client maintained a close relationship with his mother and called her every second day.

Although our client had once been in a position to provide financial assistance to his parents, his circumstances had deteriorated substantially. Our client suffered from a serious heart condition which meant that he could no longer work and his only source of income was from welfare payments. Our client lived in rental accommodation and his partner was the sole breadwinner.

Following this a settlement conference was arranged during which the executors’ made an offer of settlement in the amount of $35,000.00. Our client accepted this offer because he felt that it was a proper acknowledgment of his relationship with his mother.
