Contesting a Will for Proper Recognition of Son’s Relationship With His Mother

Our client’s mother passed away and left her entire estate to her grandchildren and family friends. Our client had always maintained a close relationship with his mother and could not understand her decision to leave him out of her will. As a result our client contacted the Contesting Will team at GMP to enquire about contesting a will.

Our client had always been close to his mother and assisted his parents to buy their house. Our client provided ongoing financial assistance to his parents and maintained a particularly close relationship to his mother. Our client always made sure that his mother was involved in his life and had plenty of time to spend with his children. Even after they moved to different states our client maintained a close relationship with his mother and called her every second day.

Although our client had once been in a position to provide financial assistance to his parents, his circumstances had deteriorated substantially. Our client suffered from a serious heart condition which meant that he could no longer work and his only source of income was from welfare payments. Our client lived in rental accommodation and his partner was the sole breadwinner.

Although this was a small estate our client instructed Garbis Kolokossian of our Contesting a Will team to pursue a claim on his mother’s estate, because he felt that the provisions of her will were not a proper reflection of their relationship. Garbis understood our client’s position and made sure that our client understood every step that was taken in his matter. Garbis filed proceedings on our client’s behalf in the Supreme Court of New South Wales. Following this a settlement conference was arranged during which the executors’ made an offer of settlement in the amount of $35,000.00. Our client accepted this offer because he felt that it was a proper acknowledgment of his relationship with his mother. Our client appreciated the effort made by Contesting a Will Lawyer Garbis to keep our client in the loop throughout the process and the effort he put in to secure a good result for our client.
