Adult Daughter in NSW Makes a Claim on her Late Father’s Queensland Estate

Gerard Malouf and Partners was contacted by the adult daughter of a deceased man in Queensland seeking advice on what her rights and entitlements were with respect to the Estate of her late father.

The father had passed away in the state of Queensland. Our law firm services the entire East Coast of Australia and are experts in representing people in Queensland in matters where children have not been adequately provided for out of their parents’ estate.

As an adult child our client had done everything possible to maintain contact with her late father. Her disabled sister was provided with the entire Estate. Whilst her sister had disabilities she did have her own family and did have adequate financial resources to be able to provide for herself independently.

After providing our client with initial advice on how to contest a Will, Gerard Malouf and Partners was instructed to proceed with the case against the Will of our client’s deceased father.

Proceedings were commenced in the District Court of Brisbane and the parties submitted the relevant affidavit evidence.

The lawyer handling the case was Mr Garbis Kolokossian who continued to engage with the Defendants with a view of attempting to bring about an early resolution of the matter without the need to have our client go to Brisbane for the purposes of participating in a Mediation conference.

Unfortunately, a settlement was not able to be achieved and accordingly Gerard Malouf and Partners forced the Defendant to participate in a mediation by expediting the claim after obtaining orders from the Court.

The parties all attended Brisbane at which point in time a private mediation conference was undertaken at the Law Society Building.

After an extensive day of negotiation our client was extremely happy to walk away with the result in excess of $250,000.
