Daughter doubles the amount left to her under her father’s will

Our client’s father passed away leaving his home, and the majority of his estate, to his third wife, whom he had only been married to for 6 months. Our client was devastated by this especially as she and her father were close. She turned to GMP Contesting Wills Lawyers to help her through a potential contesting a will claim.

Our client grew up on a farm in rural NSW and was very close to her father. She helped out on the farm performing many different tasks. Her father loved sports so she spent most of her spare time playing cricket with him. Even after she moved to the city to study and work she maintained regular contact with her father, and visited them at least once a month.

Our client spent time on her father’s property looking after him after he had surgery. She also looked after the farm when her father went on holidays. Over the years our client came to suffer from various medical illnesses. Despite this she still travelled to visit her father on his rural property, as she loved seeing her father and wanted her children to know their grandfather.

Our client was living off an Aged Pension. She was struggling with physical and mental conditions, and her house was in disrepair. She had a very small amount of savings. She required funds to plan for her future and to have the surgery she required.

After seeking advice from GMP Contesting Wills Lawyers, and in particular, David Cossalter it was found that she had a valid contesting a will claim. David immediately commenced court proceedings on behalf of our client.

Through correspondence with the executors of the estate, David was able to settle the matter out of court. Our client received double the amount which had been left to her under the will. Our client was particularly pleased that the matter was settled out of court.
