Dispute ensues over Nipsey Hussle’s estate

The family of late rapper Nipsey Hussle are allegedly in the middle of an estate dispute over administrative control. Though the 33-year-old’s brother had requested to be named the administrator of the estate, according to reports, the mother of the late rapper’s daughter is seeking to claim this duty.

A request for administration

Hussle was shot outside of his clothing store in Los Angeles on March 31, and was survived by his two children, whom he had from two different relationships. As Hussle didn’t have a Will at the time of his death, California law outlines that his fortune is divided equally between his children.

Both of his children are currently minors, meaning that their respective mothers are entitled to their child’s share until they reach the age of 18. The motivations behind the mother of his daughter’s alleged wishes to administrate the estate is unknown.

What happens if I die without a Will?

Dying without a Will in New South Wales is known as intestacy. In these circumstances, there is a hierarchy of inheritance, outlined in the Succession Act 2006 (NSW). If you die with a spouse, they have the right to inherit your entire estate, however, any children you share are entitled to a division. Parents of those without a spouse or children will inherit their estate, followed by siblings and grandparents.

If you believe that you have a claim to the estate and haven’t been catered for in this division, the Family Provisions Act 1982 (NSW) states a number of eligible persons who can contest. This includes the aforementioned, as well as:

  • Grandchildren of the deceased.
  • Someone who had been their dependent.
  • A person who had lived in a household of which the deceased was a member.

After determining whether you meet the above criteria, a Court will then need to investigate your relationship with the deceased and if they had a moral obligation to provide for you in the event of their death. This is generally noted as financial support to further your education or advancement in life.
