Disinherited Adult Daughter Contests Father’s Will and Wins $425,000

An adult daughter from New South Wales contacted Gerard Malouf and Partners seeking advice on whether she would be able to contest her father’s will which left her inadequately provided for. During her first free consultation she was advised on how to contest a will, and the process of making a family provision claim, as well as the possible outcomes of her claim.

Throughout her childhood our client had a strained relationship with her father. The relationship was so toxic that our client ran away from home at the age of 16.

Unfortunately her then partner was not a good influence which led her down the path of drug and alcohol abuse and eventually caused her to become an addict. During the time she was staying with her partner, they were arrested and charged with drug offences. Her father had to pay $50,000 so she would be released on bail. After a two year long trial she was acquitted of all charges.

During her trial, our client found out that she was pregnant and this kick started her journey to rehabilitation. After becoming sober, she returned to live at home however her relationship with her parents was still quite strained. After six months she decided to move to Darwin where she would send her parents Christmas, Mother’s Day, Father’s Day and Easter cards every year.

In order to achieve the best possible outcome Gerard Malouf and Partners Expert Lawyers took immediate action in attempting to reach a settlement that both parties were happy with. In order to do so the matter was progressed to a mediation, where offers were exchanged over the course of five hours. Finally, both parties agreed to an amount of $425,000 to be paid to our client. Once again Gerard Malouf and Partners Expert Lawyers were able to successfully contest a will without the matter having to proceed to a Hearing. The client was ecstatic with the outcome as this will assist her in purchasing a car and repaying her debts.
