Step Daughter from St Clair Makes Successful Claim on $200,000 Estate

A lady from St Clair contacted GMP Contesting a Will Lawyers requesting advice in relation to contesting a Will of her late Step-Mother who passed away almost twelve months prior. Initially our client was advised that she was eligible to make a claim and was advised on the process of contesting a will.

GMP on behalf of our client immediately put the estate on notice of our intention to make a claim.

It became clear that the estate was only worth approximately $200,000.00 less the costs that the estate would incur in defending our client’s claim.

We provided our client with advice on how to contest a Will and best ways to minimise costs when contesting a Will. With a view of ensuring that costs were kept to an absolutely minimum, GMP Contesting a Will Lawyers commenced formal proceedings as a matter of urgency filing Affidavit evidence and forcing the Defendant to participate in round table discussions with a view of attempting to bring about a full and final resolution of the matter.

The Defendant was extremely difficult to confer with and was very dismissive of our client’s entitlements to make a claim. Eventually, the Defendant agreed to participate in an Informal Settlement Conference with a view of attempting to bring about a full and final resolution of the matter without the unnecessary burden of incurring further costs.

The matter settled. GMP Contesting a Will Lawyers was extremely happy to have resolved this claim for our client in excess of $50,000.00 in circumstances where our client was left with no benefit from her step-mother’s estate.
