Adult Son of Deceased Receives Contesting a Will Settlement in Excess of $100,000

Our client initially consulted our office and spoke to our Mr Garbis Kolokossian, he received advice and information on who can contest the Will, the grounds for contesting the Will and how to contest the Will. After receiving advice with respect to all of the above, our client was advised that he had a valuable Will disputes claim and instructed our firm to make a claim for further provision out of his late father’s estate.

Our client, the adult son of the deceased, was left out of his late father’s estate even though he maintained an amicable relationship with him for the majority of his life. After the death of our client’s biological mother, his relationship with his father was strained. Nevertheless, our client encouraged his children to remain in contact with their grandfather. To our client’s surprise, after his father’s passing, he learnt that the entire estate was gifted to friends and children of friends. Our client was noticeably upset and sought the refuge of Gerard Malouf and Partners to aid him in his quest to contest his father’s Will.

After conferring with Mr Kolokossian of our office, our client was advised of the cost of contesting a Will and was advised that it would be prudent to try and resolve the matter at Mediation if possible. After preparing all of the evidence that was required, GMP Contesting Wills Lawyers commenced formal proceedings. The difficulties with this claim were that the estate was seemingly small being less than $300,000.00. Notwithstanding the difficulties, our client was able to achieve a fantastic result at Mediation which left him within excess of $100,000.00 clear in his pocket after the payment of all legal fees and disbursements.

Overall, a fantastic result for a very deserving client.
